Section 144
Power of court to hear appeal

(1) When hearing an appeal in accordance with this paragraph, the court hearing the appeal shall have the following powers:-
(a) to uphold or set aside or reverse or partially reverse the judgment of the lower court,
(b) reducing or increasing the amount of punishment imposed on the offender by the lower court or altering the punishment,
(c) If the decision was made without understanding the evidence to be understood, to understand such evidence himself or to order the lower court to understand it,
(d) If there is no decision on the matter to be decided in the case, to decide on such matter himself or to send it to the lower court for decision
(e) making incidental or consequential changes in the judgment of the lower court.
(2) If there has been an appeal by a particular offender or defendant against the decision made by the lower court, and in deciding such appeal, if it appears that the decision of the lower court is different in the case of the offender or defendant who did not appeal, the court hearing the appeal shall open the reason for the same in the case of such offender or defendant. can make a decision according to the law by using the rights mentioned in
(3) Notwithstanding anything contained elsewhere in this section, the appellate court may exercise the powers vested in the lower court as necessary.
